01 Acceptance of Terms

These Terms constitute a legally binding agreement between you ("User") and MistNex Dynamics (Pvt) Ltd, a company registered in Zimbabwe. By creating an account or placing an order, you acknowledge that you have read, understood, and agree to these Terms and our Privacy Policy.

We reserve the right to modify these Terms at any time. Continued use of the app after changes constitutes acceptance of the revised Terms.

02 Eligibility

You must be at least 13 years of age to use Meal Dash. By using the app, you confirm that you meet this requirement.

Farmers and vendors registering on the platform must be legally authorised to sell food items in Zimbabwe. Drivers must hold a valid driver's licence and meet all legal requirements to operate as a delivery driver.

03 The Service

Meal Dash is a marketplace platform that connects:

• Restaurants who list and sell fresh food items.
• Customers who browse, purchase, and receive produce delivered to their location.
• Drivers who collect orders from farmers and deliver them to buyers.

We are a technology platform. We facilitate transactions between users but do not ourselves sell, prepare, or deliver food. MistNex Dynamics (Pvt) Ltd is not responsible for the quality, safety, or legality of items listed by restaurants.

04 User Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You agree to:

• Provide accurate and complete registration information.
• Notify us immediately of any unauthorised use of your account.
• Not share your account credentials with any other person.
• Not create more than one account per role (buyer, farmer, or driver).

We reserve the right to suspend or terminate accounts that violate these Terms.

05 Orders & Payments

Placing Orders

By placing an order, you make an offer to purchase the selected produce at the listed price plus the applicable delivery fee. Orders are only confirmed once accepted by the restaurant.

Pricing

All prices are displayed in Zimbabwean dollars (ZWG) or USD as indicated. Prices are set by restaurants and may change without prior notice. Delivery fees are calculated based on distance at the time of ordering.

Payment

Currently, payment is made in cash directly to the driver upon delivery. We do not process card payments or hold funds. Future payment methods may be added and will be communicated via the app.

06 Delivery

Delivery is provided by independent drivers who are registered on the platform. Delivery times are estimates and may vary due to distance, traffic, weather, or produce preparation time.

You are responsible for providing an accurate delivery address. We are not liable for failed deliveries caused by incorrect address information.

07 Restaurant Terms

By registering as a restaurant on Meal Dash, you agree to:

• Only list produce that you legally own and are authorised to sell.
• Ensure all product descriptions, photos, and pricing are accurate.
• Accept or decline orders promptly through the app.
• Prepare orders to the agreed standard and have them ready for driver collection.
• Comply with all applicable Zimbabwe food safety and trading laws.

MistNex Dynamics (Pvt) Ltd reserves the right to remove listings that violate our guidelines or applicable laws without prior notice.

08 Driver Terms

By registering as a driver on Meal Dash, you agree to:

• Hold a valid driver's licence and be legally authorised to operate a delivery vehicle in Zimbabwe.
• Maintain your vehicle in a roadworthy condition.
• Handle produce with care to ensure it arrives in good condition.
• Collect and deliver orders promptly and professionally.
• Accurately report delivery status through the app.

Drivers operate as independent contractors, not employees of MistNex Dynamics (Pvt) Ltd.

09 Prohibited Conduct

You agree not to:

• Use the app for any unlawful purpose or in violation of any applicable laws.
• List, sell, or purchase prohibited or counterfeit goods.
• Attempt to manipulate prices, ratings, or reviews fraudulently.
• Harass, threaten, or abuse other users.
• Attempt to reverse-engineer, hack, or disrupt the platform.
• Create fake accounts or misrepresent your identity.
• Use the platform to conduct transactions outside of the app to avoid fees.

Violation of these rules may result in immediate account suspension or termination.

10 Intellectual Property

All content, design, code, trademarks, logos, and materials in the App are the intellectual property of MistNex Dynamics (Pvt) Ltd or our licensors and are protected by applicable copyright and trademark laws.

The "Meal Dash" name, logo, and branding are trademarks of MistNex Dynamics (Pvt) Ltd. You may not use our branding without prior written permission.

Restaurants retain ownership of their product photos and descriptions but grant MistNex Dynamics (Pvt) Ltd a non-exclusive licence to display them within the platform.

11 Limitation of Liability

Meal Dash is provided "as is" without warranties of any kind. To the fullest extent permitted by law, MistNex Dynamics (Pvt) Ltd is not liable for:

• The quality, safety, or fitness of produce listed by restaurants.
• Losses arising from failed or delayed deliveries.
• Any indirect, incidental, or consequential damages arising from use of the platform.
• Technical interruptions, outages, or errors in the app.

Your use of the platform is entirely at your own risk. Our maximum liability to you for any claim shall not exceed the value of the specific order in dispute.

12 Governing Law

These Terms are governed by and construed in accordance with the laws of Zimbabwe. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Zimbabwe.
